New York Passes Paid Prenatal Personal Leave

New York state has amended its labor code to require employers to provide employees up to 20 hours of paid prenatal personal leave during any fifty-two week calendar period.

“Paid prenatal personal leave” means leave taken for the health care services received by an employee during their pregnancy or related to such pregnancy, including:

  • physical examinations,
  • medical procedures,
  • monitoring and testing, and
  • discussions with a health care provider related to the pregnancy.

Paid prenatal personal leave is in addition to the sick leave that employees are entitled to under state law.

This leave goes into effect on January 1, 2025
