Voting Leave Notice to Employees

  • District of Columbia: DC law requires employers to post this notice, which advises employees of provisions for taking paid administrative leave to vote in elections held in the District of Columbia and in other places where their employees are eligible to vote. This notice must be posted conspicuously at all sites where employees report to work or by otherwise providing this notice to employees. If the notice is provided to remote employees electronically, then employers should get their acknowledgment of receipt. Employers should post the notice as soon as possible in advance of the upcoming presidential election.
  • New York: As a reminder, not less than ten working days before every election (including, for example, the upcoming presidential election), every employer must post conspicuously in the workplace where it can be seen as employees come or go to their place of work, a notice setting forth employees’ voting leave rights. The notice must be kept posted until the close of the polls on election day. You can find a sample notice here. Employers should consider leaving this notice up all year, as it provides general time off to vote information and satisfies an employer’s requirement to provide notice for each election.
  • California: The California Elections Code section 14001 requires employers to post a notice to employees advising them of provisions for taking paid leave for the purpose of voting in statewide elections. A sample of this notice, as well as a notice to employers regarding time off for voting is available here, or you may call the Elections Division at (916) 657-2166 to order posters of the notices. Employers must post the employee notice 10 days before a statewide election (including the upcoming presidential election). The employee notice must be posted either in the workplace or where it can be seen by employees as they enter or exit their place of work.
