Michigan Implements New Sick Leave, Minimum Wage Laws

After a protracted legal battle, the Michigan Supreme Court recently held that the Improved Workforce Opportunity Wage Act and the Earned Sick Time Act will take effect on February 21, 2025. Under the Earned Sick Time Act (which replaces the state’s current Paid Medical Leave Act), employers will be required to provide the following:

  • Allow employees to accrue one hour of earned sick time for every 30 hours worked;
  • For employers with 10 or more employees, allow employees to use up to 72 hours of paid earned sick time per year; and
  • For employers with 9 or fewer employees, allow employees to use up to 40 hours of paid earned sick time and 32 hours of unpaid earned sick time per year.

Under the Improved Workforce Opportunity Wage Act, a new state minimum wage take effect. It will ultimately be determined by the state treasurer, who will adjust from $10/hour to account for inflation.
