Change to Massachusetts’s Paid Family and Medical Leave Act

Currently, the Massachusetts Paid Family and Medical Leave Act (PFMLA) does not allow employees to use accrued paid leave – such as PTO, sick time, and vacation time – while receiving PFMLA benefits. Effective November 1, 2023, however, employees will be able to supplement PFMLA benefits with accrued paid leave to receive up to 100% of wage replacement during their PFMLA-qualified leave, i.e., to make themselves whole.

Note that employers are prohibited from requiring employees to use accrued paid leave while receiving PFMLA benefits.
