Illinois Expands Blood and Organ Donation Leave to Part-Time Employees

Under the Illinois Employee Blood and Organ Donation Act, employers with 51 or more employees must provide leave to a “participating employee” to donate blood or an organ. “Participating employee” means a full-time employee who has been employed by an employer for a period of 6 months or more and who donates blood or an organ.

Now, Illinois has expanded the Act to require employers to offer such leave to part-time employees as well. For a part-time employee using leave, the employer must calculate the daily average pay the part-time employee received during his or her previous two months of employment and compensate the part-time employee in the amount of the daily average pay for the leave days used.
