Delaware Passes Pay Transparency Law

Delaware has become the most recent state to pass a pay transparency bill into law. Effective September 26, 2027, employers with 26 or more employees must disclose all of the following in the notification of each job opportunity in both internal and external job postings:

  • The hourly or salary compensation or the hourly or salary compensation range; and
  • A general description of the benefits and other compensation applicable to the job opportunity.
     

The requirements apply to jobs located in Delaware and non-international remote positions offered by an employer based in Delaware.

Covered employers must make, keep, and preserve records of job descriptions and salary or wage rate history for each employee for a period of not less than three years.
