Delaware Employers Allowed More Time to Respond to Workers’ Compensation Claims

Delaware has passed a bill providing employers more time to respond to their employees’ workers’ compensation claims. Effective October 1, 2023, the following deadlines have been extended:

  • The amount of time an employer has to timely return a separation notice to the Department of Labor indicating the reason for the claimant’s separation from work with them and the claimant’s last date of work with them has increased from seven calendar days to 15 calendar days.
  • The amount of time an employer has to appeal a workers’ compensation determination has increased from 10 calendar days to 15 calendar days.
  • The amount of time an employer has to further appeal an appeals tribunal’s workers’ compensation decision has increased from 10 calendar days to 15 calendar days.
