Washington State Adds Rules Regarding Pandemic Unemployment Overpayments

The Employment Security Department of the state of Washington has made an amendment to their emergency rule concerning repayment requirements for pandemic unemployment overpayments. 

In particular, the amendment includes two new rules regarding waiver eligibility. 

The first clarifies that employees are not eligible for waivers for conditional benefits, except for benefits paid for the week beginning on February 2, 2020, through the week ending on September 4, 2021.

The second concerns the process for requesting overpayment waivers for overpaid benefits for the same timeframe – for all federal and state unemployment compensation programs. Employees may apply for an overpayment waiver, even if they have a history of denied waiver requests or were previously deemed ineligible.
