Updated Compliance Guidance on Pittsburgh Paid Sick Days Act

As you know, Pittsburgh recently updated the city’s Paid Sick Days Act (PSDA) by increasing both the accrual rate and amount of paid sick leave available to employees (based on employer size). Additionally, the city’s Office of Equal Protection has issued revised guidelines on how employers must administer sick leave.

The new guidelines establish new notice and recordkeeping requirements, as follows:

  • Notice of time accrued. Employers must choose and maintain a reasonable system for providing notification of accrued sick time, including listing updated amounts of sick time available on pay stubs (e.g., regular payroll statements) or in an online system where employees can regularly access the information.
  • Records retention. Employers must retain records documenting their paid sick leave policy, hours worked by employees, and sick time taken by covered employees for a period of two years. It shall allow the Office of Equal Protection to review these records with appropriate notice and at a mutually agreeable time to monitor compliance with the requirements.
