Texas has banned nondisclosure or confidentiality provisions to the extent the provisions prohibit an employee from disclosing an act of sexual abuse. As a result, employers may not include such provisions in employment agreements or settlement agreements.
The ban applies to agreements entered into before, on, or after the effective date of the law, which is September 1, 2025, meaning that any such provisions in existing agreements are considered void and unenforceable.
