Wyoming has passed a new law that essentially bans the use of noncompete agreements. The ban applies to contracts entered into on and after July 1, 2025.
The ban does not apply to:
- Noncompete agreements contained in a contract for the purchase and sale of a business or the assets of a business;
- Noncompete agreements to the extent the covenant provides for the protection of trade secrets;
- Any contractual provision providing for the recovery of all or a portion of the expense of relocating, educating and training an employee; and
- Executive and management personnel and officers and employees who constitute professional staff to executive and management personnel.
There are specific provisions dealing with noncompete agreements for physicians. You can access the enacting bill here.
